1. Who we are and what these terms cover
OnlineJobsAfrica ("OnlineJobsAfrica", "we", "us") operates an online marketplace at onlinejobsafrica.com that connects employers with remote professionals across Africa. By creating an account, browsing the directory, or otherwise using the platform, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the platform.
2. Our role — a marketplace, not an employer or agency
OnlineJobsAfrica is a venue. We help employers and talent find each other; we are not a party to any employment, contracting, or payment relationship formed between them. Specifically:
- We do not employ, supervise, or vouch for any worker, and we do not act as a staffing agency or recruiter.
- We take no commission and play no role in salary payments. Pay, terms, and working arrangements are agreed and settled directly between employer and worker, outside the platform.
- Each party is solely responsible for its own legal, tax, employment-law, and invoicing obligations in its own jurisdiction.
3. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the platform. You agree to provide accurate, truthful information when registering and to keep your account credentials secure. You are responsible for activity that occurs under your account. We offer two account types — talent (worker) accounts and employer accounts — and features differ between them.
4. Talent profiles
Talent profiles you publish are visible to the public, including search engines. You must not misrepresent your identity, skills, experience, education, or work history, and you may not create profiles on behalf of another person without their authority. You can unpublish or delete your profile at any time from your dashboard.
5. Employer subscriptions and billing
Browsing the directory is free. Contacting talent — unlocking contact details and on-platform messaging — requires a paid subscription. Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled. You can cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period, and we do not refund partial periods. Prices may change with reasonable advance notice, taking effect at your next renewal.
6. Identity verification
Workers may verify their identity using Stripe Identity, which checks a government-issued ID. A "verified" badge means an identity document check was passed at a point in time. It is not an endorsement, a background check, or a guarantee of skill, conduct, or work quality — employers remain responsible for their own screening and hiring decisions.
7. Acceptable use
You agree not to:
- harass, threaten, discriminate against, or defraud other users;
- charge workers fees for access to jobs, interviews, or placements — recruiters and agencies that charge talent are not welcome here;
- send spam or unsolicited promotions, or use the platform to advertise competing services;
- scrape, harvest, or bulk-export profiles, contact details, or other platform data;
- post content that is illegal, infringing, or deceptive, or use the platform for any unlawful purpose;
- probe, breach, or test the security of the platform, or attempt to access accounts or data that are not yours.
We may remove content, restrict features, or suspend or terminate accounts that violate these terms or put other users at risk.
8. Hiring relationships and disputes
Employers and workers contract with each other directly. Any dispute about work, pay, hours, conduct, or termination is between those parties. We are not obligated to mediate, although we may, at our discretion, act on reports of conduct that violates these terms.
9. Your content and our platform
You own the content you post (profiles, messages, descriptions). By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the platform. The platform itself — including its design, code, branding, and editorial content — belongs to us and may not be copied or reused without permission.
10. Disclaimers
The platform is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or secure, or that any profile, message, or other user content is accurate or trustworthy. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, OnlineJobsAfrica will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the platform or any hiring relationship formed through it. Our total liability for any claim is limited to the amount you paid us in subscription fees in the twelve months before the event giving rise to the claim, or USD $100 if you have paid us nothing.
12. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the platform, your breach of these terms, or any employment or contracting relationship you enter into with another user.
13. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the platform. Sections that by their nature should survive termination (including 9–12) survive.
14. Changes to these terms
We may update these terms from time to time. If a change is material, we will give notice on the platform or by email before it takes effect. Continuing to use the platform after a change takes effect means you accept the updated terms.
15. Governing law and contact
These terms are governed by the laws of the jurisdiction in which OnlineJobsAfrica is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction unless applicable law gives you mandatory rights elsewhere.
